An Airbnb or other short-term apartment rental in the Philippines should not be treated as legal simply because a platform allows the listing. Before calculating returns, verify four separate layers: the condominium or building rules, local permits, tourism-accommodation requirements, and BIR registration/tax compliance. A failure at any one layer can make the strategy unworkable.

1. Check the Building Before You Check the Nightly Rate
For condominium units, ownership does not mean the unit is free from building restrictions. Philippine Supreme Court decisions interpreting the Condominium Act recognize that a registered Master Deed, declaration of restrictions and valid house rules can bind unit owners and regulate the use and occupancy of units for the common interest and safety of occupants.
That makes the building documents the first authority checkpoint. Before buying a condo because it appears “Airbnb-friendly,” obtain the current written rules from the condominium corporation or property management office and ask specifically about minimum stay, guest registration, transient use, key handover, visitor access, commercial activity and penalties. Do not rely only on an agent’s verbal statement or on seeing other platform listings in the building.

2. There Is No Single “Airbnb Permit” That Replaces Local Compliance
Short-term accommodation can involve ordinary business-registration and local permitting requirements. The exact permit path depends on the LGU, property classification and business model. A host should verify the current requirements with the city or municipality where the unit is located before accepting bookings.
- Confirm the property’s permitted use and building classification.
- Ask the LGU Business Permits and Licensing Office what permit category applies to the operation.
- Check barangay, fire-safety, sanitary and other requirements that apply to the chosen business category.
- Do not assume a platform listing is evidence that the host has completed these steps.
3. Tourism-Accommodation Rules Can Matter
Republic Act No. 9593, the Tourism Act of 2009, treats accommodation establishments as primary tourism enterprises and gives the Department of Tourism authority over accreditation standards. The law includes hotels, resorts, apartelles, tourist inns, pension houses and homestay operators among accommodation establishments. See Republic Act No. 9593.
A single condominium unit marketed online does not automatically tell you which tourism category, if any, the operation will be placed under. The correct approach is to verify the actual model with DOT and the LGU rather than applying hotel, homestay or apartel rules by analogy. DOT’s accreditation system also asks accommodation applicants for a valid Mayor’s/Business Permit for applicable categories.
4. BIR Registration and Invoicing Still Apply
Income earned from a rental business does not become tax-free because bookings are collected through an app. BIR Revenue Regulations No. 15-2024 strengthened registration and invoicing compliance for businesses operating through digital platforms and e-marketplaces. The Ease of Paying Taxes rules also moved businesses to invoices as the primary sales document.

5. Calculate Net Return, Not Airbnb Revenue
A strategy can look attractive when it uses only nightly rate multiplied by booked nights. That is gross booking revenue, not owner return.
Net operating cash before financing = gross booking revenue − platform charges − management − cleaning paid by owner − utilities − association dues − repairs/consumables − permits/compliance costs − taxes − other operating costs.
Then separately account for financing costs and the owner’s capital invested. Do not publish or rely on an “ROI percentage” unless the occupancy assumption, nightly rate, fees, taxes, financing and time period are all disclosed.

- Get written confirmation of the building’s current short-term or transient-rental policy.
- Verify the LGU permit category before taking bookings.
- Ask whether DOT accreditation or another accommodation classification applies to your operating model.
- Complete BIR registration and invoicing requirements.
- Model at least a low, base and high occupancy scenario without presenting any of them as guaranteed.
- Include every recurring and turnover expense in the model.
- Recheck the building and LGU rules before purchasing a unit specifically for short-term rental.
